The Federal High Court, Port-Harcourt Division on Friday struck out the last of the three cases challenging the competence of Governor Mai Mala Buni led Caretaker Extra-Ordinary Convention Planning Committee.
The State Legal Adviser/Publicity Secretary, APC Delta State, E.V. Onojeghuo Esq, in a release on Friday night said that the suit was filed on behalf of Chief Great Ogboru, Festus Keyamo and their Elder Council by the personal lawyer of Chief Great Ogboru, Chief Nelson .O. Imoh of Nelson & Nelson Law Firm, Lagos State, Nigeria.
According to him, the presiding Judge, Justice Pheobe Msuen Ayua, struck out the name of National Chairman of the All Progressives Congress, the National Working Committee of the APC as well as the National Secretary, Caretaker Extra-Ordinary Convention Planning Committee, sued as 2nd, 3rd and 4th Defendants for being non-juristic persons.
The Court held that the action is non-justiciable and incurably incompetent on the ground that the substratum of the matter borders on the internal affairs of the APC.
It would be recalled that on October 15, 2021, the High Court of Justice in Delta State, struck-out an action filed by Elvis Ayomanor allegedly at the behest of Keyamo and Ogboru in Suit No: A/145/21, between Elvis Ayomanor & Ors Vs APC & Ors, challenging the APC Ward, Local Government Area and State Congresses.
It was also followed by another ruling delivered on the 22nd day of December 2021, also by His Lordship, Honourable Justice G.B Briki-Okolosi of High Court 2, Asaba, striking-out Suit No: A/139/ 2021, between Chukwusa Edafe Matthew & 14 Ors Vs. APC & Ors, which was also allegedly filed at the behest of Keyamo and Ogboru to set aside the APC Ward, LGA and State Congresses in Delta State.
Onojeghuo said, “The ruling of today has put finality on the issues surrounding the legality of the Mai Mala Buni-led Caretaker Extra-Ordinary Convention Planning Committee, which was the chief reason why a group known as APC Council of Elders issued a public notice on July 31, 2021, calling on members of the Party to boycott the Ward, LGA and State Congresses in Delta State.
“It is time, however, to come together and build our party, the APC, for the good of Deltans.”
