An Effurun Division of High Court of Justice, Delta State, Nigeria, has struck out a restraining order stopping the presentation of staff of office to HRM Sunday Odogu Okpurhe, Uduaka 1, Ovie of Mosogar Kingdom.
The restraining order was filed by Chief Wilson Odafe Omene and others praying the court to stop the Delta State Government from presenting Staff of Office to the second crowned monarch of the kingdom.
The presiding judge dismissed the order for lack of merit and abuse of court processes as they have already filed the same case at the High Court, Oghara.
The court held that the plaintiffs are not kingmakers and have been silent all through the process of screening, selection and crowning of the new king.
The court therefore wonders why they should come to court to seek for what is not possible few days to the presentation of the Staff of Office to the Ovie.
The court also held that it was mischievous for anyone who is not part of the making of a king to institute any suit against a crowned king.
The presiding Judge further held that Wilson Omene and his co-conspirators are just doing photoshopping and asked them to go back to the Oghara High Court Division, where they had earlier instituted a case against the king, the Otota and Oguedion of Mosogar Kingdom.
The presentation of Staff of Office by Governor Ifeanyi Okowa to Uduaka 1, Ovie of Mosogar Kingdom is slated for Saturday, September 24, 2022.
